The Critical Area Ordinance (CAO) is a collection of development regulations that are in place to protect and conserve the functions of environmentally sensitive areas, and to protect the community from hazards (such as floods, landslides, etc.). This is a key component in of the local development code designed to protect environmentally sensitive areas such as wetlands, frequently flooded areas, aquifer recharge areas, and geologically hazardous areas. Washington state law requires cities to protect these five types of critical areas, in alignment with the best available science.
Why are we updating now?
Under Washington state law, cities and counties are required to conduct a periodic review of their critical area ordinance to ensure the most up-to-date information and best available science is being considered when implementing environmental protections. This periodic review occurs every 10 years, as the City’s comprehensive plan is reviewed and updated. Comprehensive plans helps cities plan for the next few decades, and ultimately helps plan for growth with an equitable, sustainable, and healthy future for the residents of Burien.
Updating the CAO is crucial for implementing the Burien 2044 Comprehensive Plan, as it ensures land use regulations align with the state’s Growth Management Act (GMA). It also ensures that environmental policies support the City and communities’ vision, with effective and appropriate regulations that balance responsible growth and development. By updating the Burien’s CAO, we are demonstrating our commitment to complying with the GMA, reducing the risk of legal challenges or penalties, as well as committing to our natural environment for longterm health.
What is the process?
The City has hired Facet, an environmental and engineering firm, to assist with the technical portion of the update. The consultants will work with City staff to identify areas of opportunity and provide technical support in code development.
- Best Available Science Review: Documentation of scientific sources that inform regulations and explain why a policy may differ from the science.
- Gap Analysis: Identifies policies areas within the ordinance that need to be updated based on the best available science, or to comply with federal policies.
- Public and Community Participation and Engagement: Ensuring the changes reflect the vision, needs, and goals of the community.
- Draft Ordinance: This is where we will share the proposed changes to the development regulations within the CAO for review by the public.
- Formal Comment Period: An engagement period where the public and community members can share their input and feedback on the proposed changes in the draft policy of the CAO.
- Final Development Regulations: This will be the final ordinance approved by City Council. The Council Hearing on Critical Areas is tentatively scheduled for November.

- Complete a survey: A survey will be posted on our Community Hub page in summer 2025 for an opportunity to share your insight and feedback on the CAO.
- Attend a public meeting: Follow progress and provide feedback on the CAO update by attending upcoming Planning Commission and City Council meetings. Agendas and packet materials will be posted ahead of the meeting.
